Terms of Use

These Terms of Use govern your access to and use of the NASFAM website, digital content, and online services. Please read them carefully before using the site.

Acceptance of Terms

By accessing or using the NASFAM website at www.nasfam.org(the "Site") or any associated digital service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree with any part of these Terms, you must not use the Site.

These Terms apply to all visitors, users, and others who access or use the Site. They apply in addition to any other specific terms or policies referenced on particular pages of the Site, including our Privacy Policy and Cookie Policy.

We reserve the right to update these Terms at any time. Continued use of the Site after any changes constitutes acceptance of the revised Terms. The "Last Updated" date above indicates when the most recent changes were made.

Permitted Use of the Website

Subject to these Terms, NASFAM grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Site for personal, non-commercial purposes and for legitimate organisational information gathering.

Permitted Uses

  • Browsing and reading publicly available content
  • Downloading publications and resources made available for public download
  • Submitting enquiries through the Contact Us form
  • Subscribing to newsletters and programme updates
  • Registering for events listed on the Site
  • Sharing content on third-party platforms using the sharing features provided

Conditions of Use

  • You must not use the Site in any way that causes, or may cause, damage to the Site or impairment of its availability
  • You must not use automated tools to scrape, harvest, or extract data from the Site without prior written consent
  • You must not misrepresent your identity, affiliation, or purpose when using the Site

Intellectual Property

Unless otherwise stated, NASFAM and/or its licensors own all intellectual property rights on the Site and in the material published on it. All such rights are reserved.

NASFAM-Owned Content

The NASFAM name, logo, and all associated marks are registered trademarks or service marks of the National Smallholder Farmers Association of Malawi. Nothing in these Terms grants you any right to use any trademark, logo, or trade name without prior written consent.

Licensed Use

You may print or download extracts from the Site for personal, non-commercial use, provided that:

  • NASFAM is acknowledged as the source
  • Our copyright notice is included on all copies
  • No modifications are made to the content
  • No images, graphics, or photographs are used separately from accompanying text

Republication

Any republication, redistribution, or commercial use of NASFAM content, including programme reports, research publications, and photographs, requires prior written approval from NASFAM Communications. Contact media@nasfam.org to request permission.

User Submissions

When you submit content to us — including enquiry form submissions, event registration responses, job applications, or correspondence — you grant NASFAM a non-exclusive, royalty-free licence to use, process, and store that content for the purposes for which it was submitted.

You warrant that any content you submit is accurate, does not infringe any third-party rights, and is not defamatory, offensive, or otherwise unlawful. NASFAM reserves the right to remove or refuse any user submission that violates these standards.

Job applications and unsolicited submissions may be retained for a period of up to six months in line with our data retention policy. You may request deletion at any time by contacting info@nasfam.org.

Prohibited Conduct

You must not use the Site to:

  • Conduct any unlawful activity or facilitate any unlawful act
  • Transmit any unsolicited or unauthorised advertising or promotional material
  • Introduce any viruses, trojans, worms, logic bombs, or other malicious or harmful material
  • Attempt to gain unauthorised access to any part of the Site, its servers, or any server, computer, or database connected to the Site
  • Attack the Site via a denial-of-service attack, distributed denial-of-service attack, or any other disruptive technical means
  • Impersonate NASFAM, its staff, partners, or any other person
  • Post or transmit content that is defamatory, obscene, abusive, threatening, or invasive of another person's privacy
  • Harvest or collect email addresses or other contact details from the Site for the purpose of sending unsolicited communications
  • Use the Site in any way that could damage the reputation of NASFAM or its partners
  • Circumvent or attempt to circumvent any security measures on the Site

Breach of these prohibitions may constitute a criminal offence. NASFAM will report any such breach to the relevant law enforcement authorities and will cooperate fully in any resulting investigation.

Disclaimers and Warranties

The Site is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Content Accuracy

While NASFAM endeavours to ensure that information on the Site is accurate and up to date, we make no representations or warranties as to the accuracy, completeness, or reliability of any content. Programme details, market prices, and event information are subject to change without notice.

Availability

NASFAM does not guarantee that the Site will be available at all times, uninterrupted, or free of errors. We reserve the right to suspend, restrict, or terminate access to the Site at any time for maintenance, security, or operational reasons.

Professional Advice

Nothing on the Site constitutes legal, financial, agronomic, or professional advice. For specialist guidance, you should consult a qualified professional.

Limitation of Liability

To the fullest extent permitted by applicable law, NASFAM, its officers, employees, agents, partners, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your inability to access the Site or use its services
  • Losses resulting from reliance on any content published on the Site
  • Damage to your computer, device, or network caused by visiting the Site
  • Losses arising from third-party sites accessed via links on the Site

Where liability cannot be excluded by law, NASFAM's total liability to you in connection with the Site shall not exceed MWK 10,000 (ten thousand Malawian Kwacha).

Indemnification

You agree to indemnify, defend, and hold harmless NASFAM and its officers, directors, employees, agents, and partners from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the Site
  • Your violation of these Terms
  • Your violation of any applicable law or regulation
  • Any content you submit, transmit, or make available through the Site
  • Any third-party claim that your use of the Site infringes their rights

Third-Party Content and Links

The Site may include content provided by third parties or links to external websites. NASFAM does not endorse, approve, or control third-party content and is not responsible for the accuracy, legality, or appropriateness of any external material.

Links to third-party websites are provided for your convenience only. Accessing those sites is at your own risk and subject to their own terms of use and privacy policies. NASFAM shall not be liable for any loss or damage arising from your use of any linked website.

Termination of Access

NASFAM reserves the right, in its sole discretion, to restrict, suspend, or terminate your access to the Site at any time and for any reason, including breach of these Terms, without prior notice or liability.

Upon termination, all provisions of these Terms that by their nature should survive termination shall continue in full force and effect, including intellectual property provisions, warranty disclaimers, limitations of liability, and indemnification obligations.

Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the Republic of Malawi. You irrevocably agree that the courts of Malawi shall have exclusive jurisdiction over any claim arising from, or related to, these Terms or your use of the Site.

Before initiating any legal proceedings, you agree to first attempt to resolve any dispute informally by contacting NASFAM at info@nasfam.org. NASFAM will endeavour to acknowledge your complaint within five working days and propose a resolution within 30 calendar days.

Changes to These Terms

NASFAM reserves the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we will also post a notice on the Site homepage for at least 14 days before the changes take effect.

Your continued use of the Site after any changes constitutes your acceptance of the new Terms. If you do not agree to the revised Terms, you must stop using the Site. We encourage you to review these Terms periodically to stay informed of any updates.
